Privacy Policy - Basics
1. General provisions
1.1. These rules for the purchase and sale of goods (hereinafter "Rules"), upon their approval by the Buyer (after familiarizing with the Rules and ticking the box next to the statement "I have familiarized myself with the rules of "solixaart.com", Solveigas Petrovaitė's individual activity 1364518. and I agree with them"), are for the parties a mandatory legal document, which sets out the rights and obligations of the Buyer and the Seller, the terms of purchase and payment for goods, the procedure for the delivery and return of goods, the responsibility of the parties and other provisions related to the purchase and sale of goods in the "solixaart.com" online store.
1.2. The seller reserves the right to change, amend or supplement the Rules at any time, taking into account the requirements established by legal acts. The registered Buyer will be informed about any changes, corrections or additions during the login on the "solixaart.com" page and, in order to shop in this online store, he will have to reconfirm the changed Rules.
1.3. Online store "solixaart.com" trade throughout Europe. However, it is also carried out outside of Europe, when buying larger works of art.
1.4. You have the right to buy in our online store:
1.4.1. able-bodied natural persons, that is, persons who have reached the age of majority, whose capacity is not limited by court order;
1.4.2. minors between the ages of fourteen and eighteen, only with the consent of their parents or guardians, except in cases where they dispose of their income independently;
1.4.3. legal entities;
1.4.4. authorized representatives of all the above persons.
1.5. By approving the Rules, the buyer confirms that he agrees with the Rules, undertakes to comply with them and has the right to purchase goods in the "solixaart.com" online store.
2. Protection of personal data.
3.1. www.solixaart.com respects every Client's right to privacy. Customer Personal Data (ie name, email address, phone number, product/service delivery address, age/year of birth, product/service payment details (bank account number, payment method, etc.), purchase history, etc. (including, with the Client's consent, age, gender, date of birth, place of residence) are collected and processed for the following purposes:
3.1.1. For the purpose of e-commerce. The following Personal Data are processed: name, surname, e-mail address, phone number, product/service delivery address, age/year of birth, IP address, product/service payment data. The storage period of personal data used for the purpose of e-commerce is 5 (five) years from the day of the last connection to the Electronic Store.
3.1.2. For direct marketing purposes. The following personal data are processed: name, surname, telephone number, e-mail address, address, age, gender, date of birth, place of residence. The duration of storage of personal data used for the purpose of Direct Marketing is 5 (five) years from the day of the last connection to the Electronic Store.
3.2. The customer can give his consent to the processing of his personal data (name, phone number, e-mail address, address, age, gender, date of birth, place of residence) for the purpose of Direct Marketing. If, after giving consent to process his data for the purpose of Direct Marketing, as well as to receive Direct Marketing messages, the Customer no longer wishes to do so and informs www.solixaart.com about this, www.solixaart.com will no longer process his Personal Data for the purpose of Direct Marketing and will not send any electronic news to the Customer, except for information related to the Customer's order.
3.3. The customer has the right to cancel at any time

3.5. The Customer, as a Data Subject, has the following rights listed below in relation to the procedures for processing the Customer's Personal Data:
3.5.1. to receive from www.solixaart.com information about the processing of the Customer's Personal Data, to get acquainted with his Personal Data and how they are processed; 3.5.2. to receive information from www.solixaart.com, from which sources and which personal data of the Client was collected, for what purpose it is processed, to which recipients of the data it is provided and has been provided for at least the last 1 (one) year;
3.5.3. demand correction, destruction of the Client's Personal Data or suspension, except for storage, of the processing of his Personal Data, when the Personal Data is processed in violation of the Law on Legal Protection of Personal Data of the Republic of Lithuania and other laws.
3.6. When exercising his rights, the Customer must present his passport, identity card or driver's license. www.solixaart.com provides the Data subject free of charge with information about the processed Personal data of the Data subject once a year. The client is expected to realize his rights

3.7. The Customer's Personal Data is not provided to third parties, except in the following cases:

3.7.2. Personal data for e-commerce purposes are provided to Partners providing www.solixaart.com services related to www.solixaart.com activities;
3.7.3. In cases provided for by the laws and legal acts of the Republic of Lithuania, to the competent authorities.
3.7.2. Payments in the e-store are processed using the makecommerce.lt platform, which is managed by Maksekeskus AS (Liivalaia 45, Tallinn 10145, Estonia, reg. no.: 12268475), therefore your personal information required for payment execution and confirmation will be transferred to Maksekeskus AS.
3.8. The Customer is aware of his right to object to the processing of his Personal Data for the purpose of Direct Marketing, i.e. the Customer has the right to object immediately or later.
3.9. The Customer agrees that his Personal Data will be transferred to the Partners when fulfilling the Customer's order submitted in the Electronic Store, as well as www.solixaart.com providing Services to the Customer, as well as www.solixaart.com Partners, as specified in 3.7. point.
3.10. If the Customer does not agree with the Privacy Policy, the Customer will not be able to use the services of the Electronic Store.
3.11. www.solixaart.com implements organizational and technical measures to protect Personal data from accidental or unlawful destruction, alteration, disclosure, as well as from any other unlawful processing.
3.12. The Client agrees that in cases where it is necessary according to the instructions of the competent authorities and/or the Client's Personal Data may have been used in the course of illegal activities, or there are reasonable suspicions of identity theft for which the competent law enforcement authorities are conducting a pre-trial investigation, or there are other legitimate grounds or purposes, his Personal Data would be stored on the servers of www.solixaart.com for a longer period than specified in this Privacy Policy.
3.13. After receiving the Data Subject's instruction or inquiry related to the processing of Personal Data, www.solixaart.com provides the Client with an answer, satisfying the request/instruction or refusing to do so with reasons, no later than within 30 (thirty) calendar days from the date of the Data Subject's request. If the Data Subject wishes, the answer must be given in writing.
3.14. In order for the Online Store www.solixaart.com to be able to offer the Customer full-fledged services, with the Customer's consent, information Cookies are stored on the Customer's computer (device), which are used to identify the Customer as a previous user of the Online Store, by collecting statistics on visits to the Online Store, shopping cart information. 4. Buyer's rights
4.1. The buyer has the right to purchase goods in the "solixaart.com" online store in accordance with the procedure set forth in these Rules and other information sections of the Seller's online store.
4.2. The buyer has the right to get acquainted with his personal data and the right to demand the correction of incorrect, incomplete, inaccurate personal data by submitting such a request to the Seller by e-mail. by mail (solixart@info.com) or by contacting the Seller by phone (tel. no: 862219417). The Seller corrects/corrects the data specified by the Buyer no later than within 2 (two) working days.
4.3. The buyer has the right to refuse the contract of purchase and sale of goods concluded with the "solixaart.com" online store by notifying the Seller in writing (by e-mail to solixaart@infoGmail.com, indicating the desired return of the product and its order number) no later than within 14 ( fourteen) working days from the day of delivery of the goods.
4.4. The right provided for in Clause 4.3 of the Rules can be exercised only by the Buyer who is considered a consumer according to the provisions of the Consumer Rights Protection Law of the Republic of Lithuania (Zin., 1994, No. 94-1833; 2007, No. 12-488), i.e. a natural person who declares his will to buy , buys and uses a product or service to meet personal, family, household needs that are not related to business or profession.
4.5. The rules for withdrawing from the contract according to Clause 4.3 of the Rules are set by the Civil Code of the Republic of Lithuania and the Rules for the Sale of Goods and the Provision of Services When Contracts are Signed Using Communication Means, approved by the Minister of Economy of the Republic of Lithuania in 2001. August 17 by order no. 258 (Zin., 2001, No. 73-2583; 2011, No. 161-7654).
4.6. The buyer (consumer) can use the right to refuse the contract of purchase and sale of goods only if the goods have not been damaged or their appearance has not fundamentally changed. Changes to the appearance of the product or its packaging, which were necessary to inspect the received product, are not considered as essential changes to the appearance of the product.
5. Obligations of the buyer
5.1. The buyer must pay for the goods and accept them in accordance with the procedure established by these Rules (Chapters 8 and 9 of the Rules).
5.2. After registering, the Buyer undertakes not to transfer his login data to third parties. If the Buyer loses his login data, he must immediately inform the Seller about this via the means of communication specified in the "Contacts" section.
5.3. If the data provided in the registration form of the registered Buyer changes, he must update them immediately.
5.4. After submitting a written notice of withdrawal from the contract, the Buyer (consumer) must return the product (if it was delivered to the Buyer) to the Seller's pick-up point specified in clause 9.3.1 of these Rules no later than within 15 (fifteen) calendar days.
5.5. The buyer, using the "solixaart.com" online store, undertakes to comply with these Rules, other conditions clearly indicated in the online store, and not to violate the laws of the Republic of Lithuania.
6. Rights of the seller:
6.1. The Seller has the right, at his discretion, to determine the minimum size of the basket of goods, that is, the minimum amount, upon reaching which the Buyer's order will be executed. The size of this amount is visible when viewing the shopping cart.
6.2. If the Buyer attempts to harm the stability and security of the online store or violates his obligations, the Seller has the right to immediately and without warning limit or suspend his access to the online store or, in exceptional cases, cancel the Buyer's registration or block access to the online store from certain IP addresses.
6.3. In the event of important circumstances, the Seller may temporarily or completely terminate the online store without notifying the Buyer in advance.
6.4. The Seller has the right to cancel the order without prior notice to the Buyer, if the Buyer does not pay for the ordered goods within 24 hours. from the Seller's confirmation of receipt of the order, as provided for in Chapter 8 of the Rules.
7. Obligations of the seller:
7.1. The Seller undertakes to provide the Buyer with the opportunity to use the services provided by the online store "solixaart.com" under the conditions set out in these Rules and the online store.
7.2. The Seller undertakes to respect the Buyer's privacy right to personal information belonging to him, that is, to process the personal data specified by the Buyer only in accordance with Chapter 2 of the Rules and the procedure established by the legal acts of the Republic of Lithuania.
7.3. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer under the conditions specified in Chapter 9 of the Rules.
7.4. The Seller, unable to deliver the ordered goods to the Buyer due to important circumstances, undertakes to offer an analogous or similar product as far as possible. If the Buyer refuses to accept an analogous product or the product most similar in its characteristics, the Seller undertakes to return the money paid to the Buyer within 5 (five) working days.
7.5. After the buyer (user) has used Rule 4.3. the right provided for in point 4.7 of the Rules. clause, the Seller undertakes to return the money paid to the Buyer within 5 (five) working days, calculated from the day of receipt of the returned goods.
8. Payment procedure and terms
8.1 Payment through the solixaart.com system
8.2 When placing an order, you can choose payment through the paysera.lt system. Or with a credit card.
9. Delivery of goods
9.1. When the buyer orders the goods, they are delivered by courier, post office or postal machine, it will depend on which region you are ordering from and which goods.
9.2. Delivery of goods to the Buyer:
9.2.1. The buyer, who has chosen the delivery service during the order, undertakes to indicate the exact place of delivery of the goods.
9.2.2. The buyer undertakes to accept the goods himself. In the event that he cannot accept the goods himself, and the goods are delivered to the specified address and based on other data provided by the Buyer, the Buyer has no right to make claims to the Seller regarding the delivery of the goods to the wrong entity.
9.2.3. The goods are delivered by the Seller or his authorized representative.
9.2.4. Delivery (transportation) of goods in the territory of the Republic of Lithuania is paid.
9.2.5. The goods are delivered on the territory of the Republic of Lithuania and all over the world.
9.3.2. The ordered goods must be picked up no later than within 5 (five) working days, counted from the moment of receipt of confirmation from the Seller that the order is ready.
9.4. The Seller provides the goods to the Buyer in accordance with the terms specified in the product descriptions. These terms are preliminary and do not apply in cases where the Seller does not have the necessary goods in stock and the Buyer is informed of the shortage of the goods ordered by him. At the same time, the Buyer agrees that in exceptional cases the delivery of the goods may be delayed due to unforeseen circumstances beyond the control of the Seller. In this case, the Seller undertakes to immediately contact the Buyer and coordinate the terms of delivery of the goods.
9.5. In all cases, the Seller is released from responsibility for the violation of the deadlines for the delivery of the goods, if the goods are not delivered to the Buyer or are delivered late due to the fault of the Buyer or due to circumstances beyond the control of the Buyer.
10. Product quality guarantee and expiration date.
10.1. The characteristics of each product sold by solixarart.com are generally indicated in the product description attached to each product.
10.2. The seller is not responsible for the fact that the color, shape or other parameters of the goods in the online store may not correspond to the real size, shape and color of the goods due to the characteristics of the display used by the Buyer.
10.3. The seller provides a 5-day warranty for all goods
10.4. In the event that the Seller does not provide a quality guarantee for certain types of goods, the guarantee provided by the relevant legal acts shall apply.
10.5. The seller provides warranty maintenance services of the goods as an intermediary between the buyer and the manufacturer or the manufacturer's representative.
11. Return and exchange of goods
11.1. Inappropriate quality goods or quality goods, the shape, size, color, model or completeness of which the Buyer does not like, are exchanged or returned in accordance with the rules for the return and exchange of goods, approved by the Minister of Economy of the Republic of Lithuania in 2001. June 29 by order no. 217 (Journal of Laws, 2001, No. 58-2105; 2012, No. 34-1637), the Civil Code of the Republic of Lithuania and other valid legal acts of the Republic of Lithuania.
11.2. The goods sold in accordance with these Rules are included in the list provided in point 17 of the Rules for the Return and Exchange of Items (category: printed books, reproductions and other articles of the printing industry (codes according to the Combined Nomenclature - 4901-4911), therefore, quality goods are exchanged or returned at the request of the Buyer money paid for the goods, only if the Seller agrees and complies with the following conditions:
11.2.1. The seller replaces the goods with similar goods or returns the full amount of money paid for the goods in the event that the goods to be replaced or returned are not made according to the Buyer's individual order or are not obviously adapted to him;
11.2.2. If the goods are made according to the Buyer's individual order or obviously customized for him, they cannot be exchanged and cannot be returned (the money paid for such goods will not be returned to the Buyer).
11.3. In cases where the Buyer (consumer) refuses the contract concluded for goods that were manufactured according to the buyer's individual order or are obviously customized for him, 50 percent. the amount of money paid for such goods remains with the Seller as a compensation for the Seller's losses incurred during the production of a sample of the goods to be produced according to the individual order.
11.4. To return the product(s) 11.1. In the cases indicated in the clause of the rules, the Buyer must inform the Seller by e-mail. solixaart@infogmail.com
11.5. In order to return or exchange goods, the Buyer must also comply with the following conditions:
11.5.1. the returned product must be in its original, neat packaging (this clause does not apply in the case of a defective product being returned);
11.5.2. a quality product must be undamaged by the Buyer, the appearance of the product packaging has not been changed (changes to the appearance of the product or its packaging, which were necessary to inspect the product, cannot be considered as essential changes to the appearance of the product);
11.5.3. the product must be unused, without losing its appearance as a product (label intact, protective film not torn off, etc.) (this clause does not apply in the case of returning a defective product);
11.5.4. the high-quality product must be of the same configuration as the one received by the Buyer;
11.5.5. when returning the product, it is necessary to present a document confirming its purchase.
11.6. The Seller has the right not to accept the goods returned by the Buyer and/or not to return the money paid by the Buyer for the goods, if the Buyer has not followed the procedure for returning the goods specified in clauses 11.4 and 11.5 of the Rules.
11.7. The goods can be exchanged or returned in the same way as the goods were delivered, ie: by post or postmark.
11.8. The money paid for the returned goods is paid to the bank account specified by the Buyer no later than within 14 (fourteen) working days from the day of the return of the goods.
11.9. When returning or exchanging high-quality goods that meet the Buyer's order, the delivery fee for the goods is not returned or compensated to the Buyer.
12. Liability
12.1. The buyer is fully responsible for the correctness of the personal data provided by him. If the Buyer does not provide accurate personal data, the Seller is not responsible for the resulting consequences and acquires the right to demand compensation from the Buyer for direct losses incurred.
12.2. The buyer is responsible for the actions taken while using this online store.
12.3. After registering, the Buyer is responsible for transferring his login data to third parties. If the services provided by "solixaart.com" are used by a third person who has connected to the online store using the Buyer's login data, the Seller considers this person to be the Buyer.
12.4. The Seller is released from any responsibility in cases where the losses arise because the Buyer, regardless of the Seller's recommendations and his obligations, did not familiarize himself with these Rules, although he was given such an opportunity.
12.5. If the Seller's online store contains links to the websites of other companies, institutions, organizations or individuals, the Seller is not responsible for the information or activities carried out there, does not supervise or control those websites and does not represent those companies and individuals.
12.6. In the event of damage, the guilty party compensates the other party for direct losses.
12.7. The Seller is not responsible for the proper performance of mutual obligations between the Buyer and the Seller's partners, whose services the Buyer orders.
13. Exchange of information
13.1. The seller sends all messages according to 2.2 of the Rules. the procedure provided for in paragraph 1. to the e-mail address provided by the Buyer.
13.2. The Buyer sends all messages and questions using the means of communication specified in the "Contacts" section of the Seller's online store.
14. Final Provisions
14.1. These Rules are drawn up in accordance with the legal acts of the Republic of Lithuania.
14.2. Relations arising on the basis of these Rules shall be governed by the law of the Republic of Lithuania.
14.3. All disagreements arising from the implementation of these Rules shall be resolved through negotiations. If an agreement cannot be reached, disputes are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
